In 2014, three Jane Does who were sex trafficked as minors sued Backpage in federal court, alleging that the website facilitated sex trafficking by publishing ads that allowed and encouraged prostitution and human trafficking, including sex with underage girls. A district court dismissed the case, but an appeals court ruled that Backpage had engaged in traditional publisher functions with regard to third-party content and was protected by CDA Section 230.
